What needs to be done to satisfy the “collapse clause” in Roe v. Wade? The issue of abortion could have been laid to rest in this nation in 2000 through the “Innocent Child Protection Act” and another opportunity came in 2004 with the “Unborn Victims of Violence Act. We have a third opportunity with the coming “Life at Conception Act”.

What is the “collapse clause”? Justice Harry Blackmun, who wrote the majority opinion for Roe v. Wade, when he said:

“A. The appellee and certain amici argue that the fetus is a "person" within the language and meaning of the Fourteenth Amendment. In support of this, they outline at length and in detail the well-known facts of fetal development. If this suggestion of personhood is established, the appellant's case, of course, collapses, [410 U.S. 113, 157] for the fetus' right to life would then be guaranteed specifically by the Amendment. The appellant conceded as much on reargument. On the other hand, the appellee conceded on reargument that no case could be cited that holds that a fetus is a person within the meaning of the Fourteenth Amendment.”

Why has not a case been compiled with the following definitions; “child in utero means a member of the species homo sapiens, at any stage of development, who is carried in the womb” found in the Innocent Child Protection Act and “unborn child” (Sec. 1841 (d)) found in the “Unborn Victims of Violence Act? Each of these Acts has declared “PERSONHOOD” to the unborn in all stages of development. We have defined before us “PERSONHOOD”! Is this not what was lacking in the argument in Roe v. Wade?

The pro-life organizations have not addressed a legal case to take the above definitions of the “unborn” and legally overturn Roe v. Wade. Why? I have contacted numerous pro-life organizations, many up to three times, and have received only one response from my correspondence. The organization called Pro-Life Action League was the only organization to correspond with me so far. Mr. Jansen from Pro-Life Action League referred me to an interview of a pro-life attorney named Clarke Forsythe; http://thegospelcoalition.org/blogs/justintaylor/2010/01/22/overturning-and-undermining-roe-v-wade-an-interview-with-clarke-forsythe/  . In this interview Mr. Forsythe makes reference to waiting another 20 years to pursue the issue of overturning Roe v. Wade. The following is an excerpt from the letter I sent to Mr. Jansen from my first correspondence with him; “If I understand your position, the Pro-Life Action League will not pursue this legal avenue because of Clarke Forsythe’s legal opinion? Would not the above law which has classified a child in utero, at any stage, to be a member of the Homo Sapien species give every unborn child under the 14th Amendment the right to life? How could one make the assumption that the present ruling of Roe v. Wade can’t be “collapsed” without a case being presented with this new revelation of language in the above law? At this present time no one knows how the court would rule without a case. The question of “personhood” has been argued 25 times, but an argument has not been presented since this new definition has become federal law.”

With the millions of dollars which are donated to pro-life organizations what are they doing with the funds? With all of the donation money why would they not pool their donations and develop a legal case to satisfy the “collapse clause” in Roe v. Wade?

I ask you to study the language in both of these Acts. Ask yourself, why hasn’t any action has been taken to overturn Roe. The key to stopping abortion is proving that an “unborn child” is a person, a Homo Sapien, the grounds to set a foundation for this has been law in the nation since 2000 with the Innocent Child Protection Act.

My challenge to you is to draft a letter with the above information, make the contacts with elected officials and pro-life organizations-see what response you get. Folks something stinks to high heaven with this situation.

The judgment of God will come upon this nation for the 51 MILLION innocent children who have been murdered. What will you do to stop it?
